In 2001 a 51 year old electrical salesman was involved in a car accident on the Belt Parkway in Queens, NY. Although he knew he was hurt immediatly, his treatment started out with a few trips to the doctor and physical therapy. As the year went on he continued to get worse and worse. He eventaully was unable to work due to the pain. His condition got so severe that he needed cervical spine srgery. A year later he consulted our firm. Sadly, because of the delay in retaining our firm, we were unable to navigate his no-fault benefits and get him payments he was entitled to by his own insurance company. However, we immediatly comenced a lawsuit on his behalf.
This year the case came to Trial. The defendants insurance company made no offer prior to the start of trial. After the first day, the defendant's attorney offered 300,000.00 dollars. As we did not believe this would fully compensate our client, with his permisson the offer was reject and the trial proceeded. During the second day of trial, an offer was made by the defendant's attorney in the amount of $700,000.00 which was accepted by our client.
