Uninsured Motorist Coverage

Sometimes, the at fault driver in an accident may not have insurance coverage. Such drivers are known as uninsured motorists.


In such cases, you may be able to claim compensation from your own insurance company.

 

Many people carry uninsured motorist insurance coverage to compensate them in case of an accident with another driver who does not carry liability insurance. Some versions of this coverage include a certain amount for property damage. To be compensated for property damage under uninsured motorist coverage, you must demonstrate that the uninsured driver was at least to some degree at fault for the accident.

 

Whether you can collect the full amount of repair or only a percentage will depend on whether you can demonstrate that the other driver was completely at fault. Your property damage compensation may be reduced by the degree that it appears that you were at fault, called comparative negligence.

 

If you cannot show that the other driver was at fault, or if you can show only that an uninsured motorist was minimally at fault, you may still be able to claim property damage compensation under your collision coverage, because it pays for vehicle property damage regardless of fault.

 

In some states, uninsured motorist coverage is mandatory. If you are eligible to collect from both uninsured motorist property damage coverage and collision coverage for the same accident, your uninsured motorist coverage will pay for any deductible you owe under your collision coverage.
