One common tactic that virtually every insurance company uses to try to develop grounds to deny a claim or minimize the value of a settlement is to secure a recorded statement from the accident victim before they have consulted with a personal injury lawyer.

 

When an insurance adjuster takes a recorded statement from an accident victim, they are not doing so “just for the file,” but for a purpose – and that purpose is not to help the accident victim. You should understand that insurance adjusters understand the important legal issues in your case and how to get statements from you that undermine your case. Additionally, they have been trained in how to develop positive relationships with claimants (that is, people who have been hurt) so that accident victims will more easily offer up testimony that will hurt their cases. Speak to your personal injury attorney before talking to the insurance adjuster.
