Figari Law specializes in representing employees in actions for wrongful termination, whistleblower retaliation, sexual harassment and discrimination.
While employers in California may generally hire and fire employees "at will", meaning for any reason or no reason at all, employers may only terminate an individual’s employment for a lawful reason.
Employees who complain or simply report about actions they believe to be in violation of a state or federal law are protected from being retaliated against as a result of any of these complaints or reports.
There are two different types of sexual harassment: quid pro quo, and hostile work environment. Quid pro quo harassment is when an employee is promised a benefit or threatened with a negative consequence if he or she does not submit to sexual advances. "Hostile work environment" harassment is when an employee is subjected to a work environment that includes excessive sexual remarks, sexual language or comments, or other offensive conduct.
Discrimination can occur in many forms, including, but not limited to, termination of an individual’s employment. Discrimination can also include placement on a “performance improvement ‘plan,” downgraded performance evaluations, demotions or decreases in pay, termination (even as part of a larger layoff), denial of a requested leave or accommodation, failure to be promoted, subjection to a hostile work environment, unwarranted criticism in public places, solicitation of negative feedback about you from other employees, or any other action that negatively affects your employment.
